The Department of State (DOS) has issued a regulation that broadens the authority of consular officers to revoke a visa at any time subsequent to issuance of the visa, including when the individual is already in the U.S. Additionally, the regulation allows consular officers and designated officials within DOS to revoke a visa provisionally while considering a final visa revocation.
This rule is effective April 27, 2011. DOS did not issue the regulation through notice and comment rulemaking on the basis that it involves a foreign affairs function of the United States and, therefore, is exempt from those procedures.
Pursuant to section 221(i) of the Immigration and Nationality Act (INA), DOS may determine that a visa should be revoked when information reveals that the applicant was originally, or has since become, ineligible or may be ineligible to possess a U.S. visa. In testimony before Congress in 2004, DOS stated that it had revoked 1,250 visas since September 11, 2001, based on information suggesting possible terrorist activities or links. Congress and the Government Accountability Office (GAO) have put pressure on DOS and the Department of Homeland Security (DHS) to improve their policies regarding visa revocations.
If DOS revokes an individuals visa, the information will be uploaded into the Consular Lookout and Support System (CLASS) database and the foreign national may not use the visa for travel to the U.S. Though DOS will seek to notify the traveler, the revocation is effective irrespective of whether the foreign traveler knows about the revocation.
Separately, the INA allows the government to remove (i.e. deport) an individual whose nonimmigrant visa has been revoked under section 221(i). There is no judicial review of the decision to revoke the visa, but there is judicial review in the context of a removal proceeding if the visa revocation is the sole basis for removal.
Expect more denials at the port of entry to the US by individuals not aware that their visa has been revoked. I understand the need for more security but this may not be the way to go.

Hi,
I have approved labor (filed Apr 2004 and cleared Jan 2007) in EB2 category. But it was filed wrongly in EB2 as somehow it got cleared. But now I got RFE on I-140 and there is a verly bleak chance of getting it cleared.
In the meantime I am thinking to file a new labor by PERM (from same employer). I have few questions regarding this:
1. Can I file new labor in PERM without affecting my current labor and I-140 ?
YES
2. Do I have to mention in my new labor about my old labor and I-140 ?
I dont think so. CHeck with a lawyer
3. Can I use different experience letters in new labor as my old labor is in jeopardy because of experience letters only.
Check with lawyer
Thanks
DC

To all the physician members of this forum....
Conrad 30 program is up for extension on march 6.
According to shusterman.com although the extension is gonna take place, they plan to make physicians exempt from employment based category as long as they work in medically underserved areas....
If this bill includes the physician clause that will be a lifesaver for a lot of people and also help in visa retrogression albeit little bit.
Hope it passes....any thoughts anyone?

Thanks for the reply.
No, my new would be employer will not be doing H1 transfer for me. They will take the EAD route. Yes, I know the start and end date of EAD as that is printed in the approval letter.
So, I guess, although I don't have the plastic card in hand, I can start processing AC21 on the basis of EAD approval notice and A#, that gives me 90 more days.
I will read I 9 more carefully with time. Also started upgrading profile.

Hi Gazman - for the most part, almost everything is run. There may be some animation-related things that we suppress, but you can have a nested class that controls some UI on a grandparent class, and Blend will happily show you the results of it.
Let me know if you are running into any limitations.

Hi
I have been listening to the Senate proceedings for last few days & I'm very unhappy to say that so far there has been no mention of legal immigrants.None of our issues have been discussed or debated.I was thinking after doing so much of hard work ( especially by the VI team ) & all the contributions, lobbying, we would get some changes done but looks like ..
I'm not being negative here, but its just a thought.
Thanks

Consider filing a complaint with AILF. But do so at your discretion, as relationships are also *VERY* important in these matters. Better not to burn to many bridges.

I am also in the same boat, 140 was filed in March 07, file at TSC. The attorney never received the original LCA. Could not do premium processing for 140.
NOW the big question is, can I apply 485 since my PD is current now?

I have heard this from a couple of my friends who used AP recently to enter the US. The Immigration officer at the POE told them that their AP is now valid from the date it was first stamped. IOW he now has a full additional year to use the AP for travel.
However, I cannot find this documented anywhere on the USCIS site. My AP was issued in Sept 2008 and is valid till Sept 2009 and I used it to return back from India in Dec 2008. However, I plan to renew my AP 120 days before its original expiry date UNLESS a clear rule gets published clearly mentioning that it is valid for a whole extra year following the first use of the AP document.

There have been a lot of stories in the press about similar things, and everyone on the forum agrees and thats that.
Hence no replies.

thanks for your reply.what do you mean by consular processing?
could i do anything to retain my L1 visa status?
my current H1 employer is least helpful.i am getting worried and would like to continue in L1 for few months until i get a suitable opportunity.pls tell me how i can do that.
pls help.
Consular processing is requesting that the H-1 be approved and you will go to the consulate in your home country to pick up the visa and come back on a new H-1, in this situation, you are not requesting for a change of status when you file for a H-1. Your attorney will know how to file a consular processing case.

Once your I-140 is approved you can retain your Priorty dates. Even if the Company A revokes your I - 140 [ which they cannot do like that..they should have a valid reason to revoke anyones I-140 - either fraud or you are convicted for something ] . Now do you have the copy of your I-140 approval because that will be needed !
Thanks,

It's hard to answer your question without more details, such as your current status. Company B can definitely file a new H-1B for you. Your current status will dictate whether you "need" to tell them about the earlier filing. However, having a prior petition filed might not have any negative impact, so you probably don't need to be nervous about telling Co. B.

No one here could possibly know. The FULL price is probably going to be around $900 a month. But his employer would pick up, usually at least half the cost for HIS coverage - or around $250ish.

I have heard this before on other forums , too.
I believe, the USCIS CSR confused "unrestricted" SSN with a "restricted" SSN. Most people on some kind of work permit (F1,H1B, EAD) have "Eligible to work with DHS authorization" ( or something similar ) imprinted on their Social Security card ( it certainly is in my social ), and I believe people with GC/USC don't have any such thing written on their SSN ( it's purely a guess by me, I'm yet to see a GC/USC holders SS card ;) ) . So, I don't think people on work permit can work just with DL and SS card ( if they could , why would they have not done until now  ? ) .
But, on the other hand, I'd like to know, if people can continue working on the EAD receipt itself ??

Hi,
My F1 visa (I got 2 yr student visa for Fall 2007) expires in May 2009. I applied for OPT and starting date is June 1st 2009. Since my F1 visa stamping is expiring, what is my possibility of visiting India after May 09? Is there any possibility of extending my F1 Visa for another couple of yrs without leaving the country and continue on my OPT? Or any other suggestions? Please help me..

Thanks for your reply. What does DMV care about to decide till when the license will be valid?
1. H1 visa on the passport
2. H1 approval notice
3. Can I show them the AP?

Specific Adjudication Process Steps by Form Type on My Case Status: When customers check their case status online, the process steps they see will now be specific to the petition or application they submitted. Until recently, the website listed seven identical process steps for all forms, even though not all the steps applied to all the forms. With the new feature, process steps are customized for more than 40 form types.
I like that. Thanks for posting the update.
